By downloading or using WinFinder (the "App"), operated by Nexiv, Serbia ("we," "us," or "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the App.
2. Eligibility
You must be at least 16 years old (or the age of majority in your jurisdiction) to use the App. By using the App, you represent and warrant that you meet this age requirement.
3. Description of the Service
WinFinder is a statistical research tool that allows users to create custom filters based on seasons and Head-to-Head (H2H) statistics.
The App does not provide betting tips, predictions, or financial advice. It is not a bookmaker and does not facilitate gambling. All data is for informational and analytical purposes only.
4. Access, Passes, and Billing
Users can use the app without creating an account or registering. Basic features are available for free, but access to certain competitions is limited.
To unlock additional competitions, users may purchase a daily pass or a monthly pass. The scope and duration of access depend on the type of pass purchased.
All purchases, billing, and cancellations are processed through the Apple App Store or Google Play Store. We do not collect or store payment information and do not process payments or refunds directly. Please refer to the terms and policies of the respective app store for details.
If applicable, monthly passes may be subject to automatic renewal. Users can manage or cancel renewals through their app store subscription settings.
5. Disclaimer of Warranties
The data provided is sourced from third-party APIs. While we strive for accuracy, we do not guarantee that statistics, game times, or results are error-free, complete, or real-time.
The App is provided "as is" without warranties of any kind, whether express, implied, or statutory, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
6. Limitation of Liability
To the maximum extent permitted by Serbian law, Nexiv and its owners shall not be liable for:
- Any financial losses, including betting or investment losses.
- Indirect, incidental, special, consequential, or punitive damages.
- Technical inaccuracies, downtime, or data errors.
- Decisions made based on the filters or data provided. Users use the data at their own risk.
- Loss of data or account access due to your own actions or security breaches.
7. Intellectual Property & Use Restrictions
You may not reverse-engineer, scrape, or commercially redistribute the data or the App’s functionality. Your custom filters are private to your account.
All content, graphics, and software are the property of Nexiv unless otherwise stated. Unauthorized use is strictly prohibited.
8. Third-Party Services
The App may use third-party APIs. Your use of third-party data is subject to the respective provider’s terms. We are not responsible for the accuracy or availability of third-party services.
9. Changes to Terms
We may update these Terms from time to time. The latest version will be posted in the App. Continued use of the App after changes constitutes acceptance of the updated Terms.
10. Governing Law
These Terms are governed by the laws of Serbia. Any disputes shall be subject to the exclusive jurisdiction of the courts located in Serbia.
